THE SAN DIEGO UNION-TRIBUNE America’s Cup MP3 Contest
OFFICIAL RULES

TO ENTER
For a chance to win, participants are required to go to the Battle of the Bands web page at www.BattleofBands.SignOnSanDiego.com (the “Website”) to complete the registration process. NO PURCHASE IS NECESSARY TO ENTER OR WIN. The promotion begins at 12:00 p.m. on Thursday, October 13, 2011, and ends at 11:00 p.m. on Wednesday, November 9, 2011 (the “Promotion Period”). Participants are limited to one (1) valid entry per person and valid email. Entries made by the same person with different email addresses or multiple persons with the same email address are prohibited. Violation of Official Rules will result in disqualification of all entries for that person.
Contestants must upload a MP3 of their band to be eligible to win. Please upload a MP3 file.

To vote, users must register and are limited to one vote per day for their favorite MP3. America’s Cup Event Authority will select two (2) winners for 1st and 2nd place, and two (2) more bands with the most votes will win 3rd and 4th place.

The four (4) MP3 submissions that win will be notified by email or phone on November 10, 2011. America’s Cup Event Authority will coordinate performance details with each winning band.

Odds of winning depend on the number of entries received. Automated voting of any kind is not allowed. Detection of said automated voting will lead to votes being voided. Only one registered account per voter. If multiple accounts are detected for a single voter, they will be disabled and votes disqualified.

PRIZES
The three winning bands will get the opportunity to open for concerts each night of America’s Cup World Series – San Diego 2011. The 1st place band will perform on November 19, the 2nd place band will perform November 18 and the 3rd place band will perform on November 17. The 4th place band will perform on November 16 after the races in The America’s Cup Village on Harbor Drive in San Diego.
Prizes are not transferable, redeemable for cash or exchangeable for any other prize. If a winner cannot be contacted or is disqualified, the Union-Tribune and SignOn San Diego reserve the right to determine an alternate winner or not to award that winner’s prize, in their sole discretion. The Union-Tribune does not mail or deliver prizes. Winners are responsible for paying all applicable local, state and federal taxes, and all necessary licensing and insurance costs and/or arrangements. For tax reporting purposes, winner will be required to provide legal name, address and social security number or forfeit prize. Winner will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS. The San Diego Union-Tribune, LLC, and www.SignOnSanDiego.com are not responsible for lost or stolen prizes. All prizes are non-refundable or exchangeable and cash substitutions are not permitted. Unclaimed prizes will be forfeited. The Union-Tribune and SignOnSanDiego make no warranty with respect to any prize and reserve the right to substitute a prize of equal of greater value.

ELIGIBILITY
All contestants must be 21 years of age or older to enter and to win, and must show a valid driver’s license, picture ID, or other suitable means of verification. Participants must fill-in all contact information to be eligible to win. Employees of the Union-Tribune and SignOn San Diego or its agents, representatives, and affiliates, and their immediate family members and/or those living in the same household are not eligible. The Union-Tribune shall be the sole judge of eligibility and reserves the right to disqualify any entrant or entry for any reason. If it is discovered that the winner has committed fraud in obtaining the prizes, the prizes must be returned immediately to the Union Tribune. Winners agree to allow use of their name and photos by the Union-Tribune and SignOn San Diego without further compensation. The contest is subject to all federal, state, and local laws and is void where prohibited. Only residents of the State of California are eligible to win. In fairness to all, the Union-Tribune cannot discuss the contest by phone, mail or in any other way with the contestants.

OTHER CONDITIONS
The Union-Tribune reserves the right to change, modify, or extend contest dates if it should be deemed necessary. The Union-Tribune reserves the right to suspend or cancel the contest at any time. The Union-Tribune assumes no responsibility for injury or loss that may arise from participation in the contest. The Union-Tribune assumes no responsibility for computer system, phone line, hardware, software or program malfunctions, delayed computer transmissions or network connections that are human or technical in nature. The Union-Tribune reserves the right in its sole discretion to cancel or suspend this contest, in its entirety or in part should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the Union-Tribune's control corrupt the administration, security, fairness, integrity or proper play of the contest. The Union-Tribune is not responsible for incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with, or utilized in the contest by any technical or human errors that may occur in the processing of the entries in the contest. The Union-Tribune reserves the right to withdraw the transmission of this contest at any time and award the prize from among eligible entries received prior to the date of the withdrawal. The Union-Tribune reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or website or to be acting in violation of the official rules.
