ELIGIBILITY: FARMERS INSURANCE: DEL MAR RACETRACK – UNION TRIBUNE SWEEPSTAKES (the "Sweepstakes") is open to legal U.S. residents of California during the Entry Period, excluding where otherwise prohibited by law, rule or regulation, who are at least 18 years of age at the time of entry. THIS SWEEPSTAKES IS SPECIFICALLY VOID WHERE PROHIBITED BY LAW.  OBTAINING AN INSURANCE QUOTE FROM A FARMERS® AGENT OR PURCHASING ANY PRODUCT FROM FARMERS WILL NOT INCREASE YOUR ODDS OR CHANCES OF WINNING.  CHANCES OF WINNING WITHOUT MAKING A PURCHASE OR OBTAINING AN INSURANCE QUOTE ARE THE SAME AS THE CHANCES OF SOMEONE WHO PURCHASES SOMETHING OR WHO OBTAINS A QUOTE. IT IS ILLEGAL TO GIVE ANY ADVANTAGE TO BUYERS IN A SWEEPSTAKES.

Employees of Farmers Insurance Exchange ("Sponsor"), Farmers Group, Inc., the San Diego Union-Tribune (“Tribune”) or any of their promotional or advertising agencies, public relations agencies, prize suppliers, including any vendors providing services in connection with regard to this Sweepstakes (“Sponsor Affiliates”) and each of its and their respective parents, affiliates and subsidiaries, and each of their respective officers, employees, directors, members, legal representatives, agents, successors and assigns are not eligible, nor are members of these employees' families (defined as parents, children, siblings, spouse, and life partners). Proof of legal United States residency and age may be required.

HOW TO ENTER: The Sweepstakes begins at 8:00 am (Pacific Standard Time (“PST”)) on July 1, 2013 and ends at 11:59 pm (PST) on July 4, 2013 ("Entry Period"). There is only one method to enter the Sweepstakes.  Contestants may enter the Sweepstakes online by going to the following website http://utcontests.com and clicking on the Sweepstakes banners, buttons and/or links to access the online entry form for the Sweepstakes. By successfully transmitting a completed online entry form as directed, you (the “Contestant(s)”) will be entered in the Sweepstakes. All entries submitted in compliance with these Official Rules and not disqualified are considered “Eligible Entries”.

The odds of winning the Sweepstakes depend on the total number of Eligible Entries received during the Entry Period. 

Sponsor, Sponsor Affiliates, Del Mar Racetrack  and each of its and their respective parents, affiliates and subsidiaries, and each of their respective officers, employees, directors, members, legal representatives, agents, successors and assigns (collectively, the "Released Parties") are not responsible for lost, late, incomplete, garbled, illegible, or misdirected Sweepstakes entries, or for any error, human, technical or otherwise, which may occur in the processing of Sweepstakes entries. Proof of completing entry form or sending will not be deemed to be proof of receipt. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. Any use of robotic, automatic, programmed or similar entry methods will void all such entries by such methods.

PRIZE DRAWING: There will be fifty (50) Winners of the Sweepstakes (individually and collectively the "Winner(s)").  The decisions of Sponsor, including the selection of Winner(s), are final and binding on all matters relating to this Sweepstakes. Limit one (1) Prize per Contestant, person, family or household.  The Winner(s) are determined by random drawing.

PRIZE: Contestants will have a chance to win two (2) club house tickets to Del Mar Racetrack on July 28, 2013 (the “Prize(s)”). (Estimated retail value of $12 per ticket and $24 per pair).  A total of fifty (50) pairs of tickets (100 total tickets) will be awarded (Estimated total retail value of $1,200.00).

Neither Sponsor nor Sponsor Affiliates make or offer any warranty or guarantee, either express or implied (including, without limitation, quality, merchantability and fitness for a particular purpose) in connection with this Sweepstakes or any Prize.  Prize details and availability are subject to change, in which case a prize of equal value may be substituted at Sponsor's sole discretion.  Prizes consist only of the items listed, are non-transferable and non-exchangeable, with no cash redemption or substitution except that Sponsor retains the right to substitute a prize of equal or greater retail value (or at Sponsor's election, the cash value of the applicable Prize).  The Winner(s) is solely and fully responsible for any and all applicable federal, state, and local taxes (including income and withholding taxes) on the value of the Prize and, if applicable, will be issued an IRS 1099-MISC tax form for the retail value of the Prize. All costs and expenses associated with Prize acceptance and use not specified herein as being provided, related to the Prize, including but not limited to, any taxes and other expenses incurred by accepting the Prize are the sole responsibility of the Winner(s).

 The Prize(s) may not be sold, bartered, assigned, substituted or exchanged by any Winner.  In the event that the sporting event gets cancelled or postponed due to factors uncontrollable to the Sponsor, Sponsor will not be responsible for providing a substitute Prize or providing an alternate race day experience.  No cash or other substitutions or equivalents of the prize are allowed. Prizes must be redeemed and taken by no later than 3:00 p.m. PST on July 26, 2013.  Sponsor reserves the right to disqualify entrants who fail to follow these Official Rules, or who make any misrepresentations relative to this Sweepstakes and redemption of the Prize. Prizes are awarded “As Is”.

USE OF DATA: Sponsor will be collecting personal data about Contestants including, without limitation, name, phone number, mailing address, age, and biographical information, and e-mail addresses when they enter the Sweepstakes or are selected as a Winner(s).  Winner’s First Name and Last Name Initial may be posted on Farmers.com and/or Farmers’ Facebook Page.  Sponsor is entitled to use personal data contained in all entries in accordance with the Sponsor's privacy policy. By participating in the Sweepstakes, Contestants hereby agree to all personal information uses and disclaimers as explained in Sponsor's Privacy Policy located at Farmers.com.  Please click on the provided link to read and review our Privacy Policy: http://www.farmers.com/privacy_policy.html.  Contestant may opt-out of receiving future communications as set forth in Sponsor’s Privacy Policy or as provided within any such marketing materials (e.g., using the “Unsubscribe” feature provided in the footer of Sponsor’s emails).

AGREEMENT TO OFFICIAL RULES: Participation in the Sweepstakes constitutes Contestant's full and unconditional agreement to and acceptance of these Official Rules and Sponsor's Privacy Policy at Farmers.com and to be contacted by telephone and/or email.

NOTIFICATION OF WINNER(S): Winner(s) will be notified by available phone number or email address by Sponsor. To claim a Prize, Sponsor may require Winner(s) to complete, sign, and return Affidavit of Eligibility/Liability Release/Publicity Release forms, and other applicable documents, which may require a social security number, postmarked within three (3) days of the date on the notification.  Sponsor and/or Tribune will make arrangements for the fulfillment of the Prize.  Winner will be notified when and where Winner may claim his or her Prize.  At Sponsor’s discretion, Winners may be required to produce picture or some other form of proper identification to claim any Prize. Sponsor reserves the right to substitute any Prize with prize of equal or greater value. If a potential Winner cannot be contacted, fails to timely claim the Prize, is disqualified, fails to timely execute and return any required forms, or if the Prize notification is returned as undeliverable, an alternate Winner will be selected by random drawing from other Eligible Entries. If by reason or printing or other error, more Prizes are claimed than the number of Prizes set forth in these Official Rules, a random drawing will be held to award the advertised number of Prizes in the relevant category.  Under no circumstances will more than the advertised number of Prizes be awarded.

Except where otherwise expressly noted in these Official Rules, the selection of all vendors, Prizes, products and services is subject to the Sponsor's sole and absolute discretion. Additional restrictions may apply.

No refunds or credit for changes are allowed. No transfer of the Prize is permitted.  

GENERAL CONDITIONS: The Sweepstakes is governed by the laws of the United States and the State of California, excluding conflicts of laws principles. All federal, state and local laws and regulations apply. SWEEPSTAKES VOID WHERE PROHIBITED.

Except where prohibited by law, Winner(s) and Guest grant to Sponsor and its advertising agencies the right to use and publish Winner's photo, image, name, likeness, voice, opinions, biographical information and state in any media to promote the Sweepstakes without additional compensation.

By entering, Contestants and Winner(s) release, indemnify and hold harmless Sponsor and the Released Parties from any and all liability for any injuries, loss or damage of any kind, including death, arising from or in connection with the Sweepstakes or receipt or use and/or misuse of any Prize.  Under no circumstances will the Contestants or Winner(s) be permitted to obtain any award for, and the Contestants and Winner(s) hereby waive all rights to any claim(s), punitive, incidental or consequential damages, or any other damages whatsoever, including attorneys’ fees. Furthermore, Contestants and Winner(s) agree that any and all disputes and causes of action arising out of or connected with this Sweepstakes and the Prizes awarded shall be resolved solely by Sponsor, shall be final and binding, and without resort to any form of class action.  Sponsor and Sponsor Affiliates shall not be responsible for Acts of God, actions or inactions of governments and/or government agencies, acts of terrorism, civil unrest or disturbances, riots, work stoppage delays, postponements, inclement weather, rescheduling or any other natural disasters outside its respective control.

Sponsor reserves the right to cancel or modify the Sweepstakes if fraud or any other factor impairs the integrity of the Sweepstakes as determined by Sponsor in its sole discretion.

Entries are deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry and is a legal United States resident and complies with all the eligibility requirements of these Official Rules. Prize will only be awarded to the authorized account holder.

If, in Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if technical difficulties compromise the integrity of the Sweepstakes, Sponsor reserves the right in its sole discretion to void any entries at issue (including disqualifying any individual who tampers or otherwise interferes with the entry process), and to cancel, terminate, modify or suspend the Sweepstakes, in whole or in part, at any time without notice. In the event of such cancellation, Sponsor reserves the right to award Prize(s) in a random drawing from all eligible entries received before the time of cancellation.

Sponsor in no way promotes illegal acts, and any and all entries which include or promote illegal acts will be disqualified. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alternation of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, including www.farmers.com, any combination thereof, or otherwise, including any injury or damage to Contestant's or any other person's computer related to or resulting from participation or downloading any materials in the Sweepstakes.

CAUTION: ANY ATTEMPT BY AN Contestant TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Contestants in the Sweepstakes hereby consent to the exclusive jurisdiction and venue of California courts (state and federal) in Los Angeles County for any causes or controversies arising out of the Sweepstakes. Winner(s) waives any and all objections to jurisdiction and venue in these courts.
